A serious injury can devastate a person and his or her family. In addition to physical pain, an injury can cause severe emotional stress, feelings of anger and resentment, and loss of enjoyment of life. An injury can also result in severe economic hardship resulting from the inability to work and medical bills. Fortunately, California law allows you to bring a claim for damages against the person(s) or entity that caused your injuries.  Recoverable damages include “economic damages” such as property damage, loss of use of property, past and future medical expenses, loss of income, loss of earning capacity, lost profits, and the loss of ability to provide household services. They also include “noneconomic damages,” such as physical pain, mental suffering, and emotional distress.  In some cases, when the injury is caused through oppression, fraud or malice, the injured person can recover additional damages, called “punitive damages,” which are designed to punish the wrongdoer for his or her bad conduct.

Even though the law allows for the recovery of damages, personal injury claims can be difficult. There are many pitfalls and traps for the unwary.  Personal injury claims are typically defended by insurance carriers whose only goal is to delegitimize, minimize, and even outright deny your claim.  Although insurance adjusters may seem sympathetic and friendly, they are not on your side. Their only interest is to protect the wrongdoer and save money for their company. Moreover, you are dealing with them when you are at your lowest and most vulnerable, while in pain and under economic duress, which makes it easier for them to take advantage of you. They will often make “low ball” offers and dare you to challenge them in court.Then, if you do challenge them in court, they have endless resources and a team of lawyers, investigators and “expert” witnesses at their disposal to defeat your claim
