A serious injury can devastate a person and his or her family. An injury can also result in severe economic hardship resulting from the inability to work and medical bills. Fortunately, California law allows you to bring a claim for damages against the person(s) or entity that caused your injuries. Recoverable damages include “economic damages” such as property damage, loss of use of property, past and future medical expenses, loss of income, loss of earning capacity, lost profits, and the loss of ability to provide household services. They also include “noneconomic damages,” such as physical pain, mental suffering, and emotional distress. In some cases, when the injury is caused through oppression, fraud or malice, the injured person can recover additional damages, called “punitive damages,” which are designed to punish the wrongdoer for his or her bad conduct.
